1. Introduction

Welcome to KIEMONO ("Platform"). These Terms & Conditions ("Terms") constitute a binding agreement between you ("User") and KIEMONO regarding the use of Platform services, including the website, application, and all features available therein. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all or any part of these Terms, you are prohibited from using the Platform.

We reserve the right to amend these Terms at any time without prior notice. Changes shall take effect immediately upon publication on the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the updated Terms.

2. Definitions

In these Terms, unless the context otherwise requires:

• Platform — KIEMONO and all services provided through its website, application, or API.
• User — any person or entity that accesses or uses the Platform, whether registered or not.
• Collector — a User who has registered and maintains an Account on the Platform to manage, display, or trade collections.
• Content — any form of data, information, text, photographs, videos, images, descriptions, valuations, and other materials uploaded, posted, or displayed through the Platform.
• Account — the registration created by a User to access Platform features that require authentication.
• Valuation — the estimated or appraised value of a collection item displayed on the Platform, which is for informational purposes only and does not constitute an offer to buy or sell.
• HAKI — Intellectual Property Rights, including but not limited to copyrights, trademarks, patents, and industrial design rights.
• UU PDP — Personal Data Protection Law (Law No. 27 of 2022).

3. Account Usage Terms

To use certain features of the Platform, you must register and create an Account. When registering, you are required to provide accurate, complete, and current information. You are solely responsible for the confidentiality of your Account credentials (username and password) and for all activities that occur under your Account.

Platform Users must be at least eighteen (18) years of age or have obtained consent from a parent or legal guardian if under 18 years of age. By creating an Account, you represent and warrant that you meet the applicable age requirement.

Creating more than one (1) Account for the same individual is prohibited. Creating multiple accounts may result in the deletion of all related Accounts and permanent restriction of access. You must promptly notify us if you become aware of any unauthorized use of your Account.

4. Collections & Content

You retain ownership of the Content you upload or post on the Platform. By uploading Content, you grant KIEMONO a non-exclusive, transferable, and sublicensable license to use, display, distribute, and promote such Content in connection with the operation and promotion of the Platform, including but not limited to display on collection pages, feeds, and search features.

You represent and warrant that you have or have obtained all rights, licenses, consents, or permissions necessary to upload and share your Content through the Platform. You agree that you will not upload Content that infringes the rights of any third party, including but not limited to Intellectual Property Rights.

KIEMONO reserves the right, but has no obligation, to remove, modify, or reject Content uploaded to the Platform without prior notice if such Content violates these Terms or applicable law.

5. User Conduct

You agree not to use the Platform for any unlawful or unethical purpose. In particular, you are prohibited from:

• Uploading, sharing, or distributing content that violates Indonesian law or the laws of any other applicable jurisdiction.
• Engaging in harassment, threats, intimidation, or conduct that is disruptive to other users.
• Sending spam, unsolicited bulk messages, or promotional materials.
• Engaging in fraud, falsification of information, or manipulation of collection and valuation data.
• Infringing the Intellectual Property Rights of others, including uploading pirated content or another person's copyrighted works without authorization.
• Using bots, scripts, or other automated tools to access the Platform without written authorization from KIEMONO.
• Attempting to access systems, networks, or other users' accounts without authorization (hacking).
• Engaging in money laundering or any other illegal transactions through the Platform.

6. Transactions & Valuations

KIEMONO provides valuation and estimated value features for collection items that are for informational and educational purposes only. The displayed values are estimates based on certain market data and algorithms and do not constitute an offer to buy or sell, an official appraisal, or a guarantee of market value. You understand and agree that the actual value of an item may differ significantly from the displayed estimate.

Any transactions conducted through the Platform are the sole responsibility of the parties involved. KIEMONO does not act as an intermediary, guarantor, or party to any transaction unless expressly stated otherwise. You assume all risks associated with online transactions.

Using the Platform for money laundering, terrorist financing, or any other illegal activity is prohibited. KIEMONO reserves the right to report suspicious activity to the competent authorities in accordance with applicable laws and regulations.

7. Intellectual Property

All content belonging to the Platform, including but not limited to logos, designs, user interfaces, source code, databases, and promotional materials, is the property of KIEMONO or its licensors and is protected by Indonesian Intellectual Property Law and international law.

You are granted a limited, non-exclusive, and non-transferable license to access and use the Platform in accordance with these Terms. You may not copy, modify, distribute, sell, or rent materials from the Platform without written authorization from KIEMONO.

If you believe that content on the Platform infringes your Intellectual Property Rights, you may submit a notice to us via email at kiemono@example.com, including: your identity, a description of the copyrighted work allegedly infringed, the URL of the infringing content, a statement of good faith, and your signature. We will review the notice and take the necessary action in accordance with applicable law.

8. Moderation & Sanctions

KIEMONO reserves the right to moderate, edit, hide, or remove Content uploaded by Users without prior notice if such Content is deemed to violate these Terms, be detrimental to other users, or be contrary to applicable laws and regulations.

If a violation of these Terms is found, KIEMONO may impose sanctions including, but not limited to:

• Written or verbal warning;
• Temporary restriction of certain features on the Account;
• Removal of the violating Content;
• Suspension of the Account for a specified period;
• Permanent ban (permanent Account deletion) for serious or repeated violations.

Moderation and sanction decisions are at the sole discretion of KIEMONO and are not subject to legal challenge. However, Users may submit an objection via email to kiemono@example.com and we will review it in good faith.

9. Limitation of Liability

KIEMONO provides the Platform "as is" and "as available" without any warranty, whether express or implied, including but not limited to warranties of fitness for a particular purpose, non-infringement, or the continuous availability of service without interruption.

KIEMONO shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from the use of or inability to use the Platform, even if KIEMONO has been advised of the possibility of such damages.

KIEMONO shall not be liable for the accuracy of valuations or estimates displayed on the Platform, or for decisions made by Users based on such information.

KIEMONO shall not be liable for service failures or delays caused by events beyond reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, power outages, third-party internet network disruptions, or governmental actions (force majeure).

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is available at Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy, which forms an integral part of these Terms.

11. Changes to Terms

KIEMONO reserves the right to modify, amend, or update these Terms at any time at our sole discretion. Changes will be published on the Platform along with the date of the last update. We encourage you to review these Terms periodically. Material changes will be communicated via email or a notice on the Platform at least seven (7) days before taking effect.

Your use of the Platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to such changes, you must cease using the Platform and delete your Account.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any dispute arising out of or in connection with these Terms shall first be resolved through deliberation and mediation in good faith.

If a dispute cannot be resolved through deliberation within thirty (30) calendar days from the date one party submits a written request for mediation, the dispute shall be submitted to and resolved by the competent District Court within the jurisdiction of KIEMONO, which the parties agree shall be the sole forum of competent jurisdiction (forum conveniens).

13. Service / Account Termination

You may delete your Account at any time by contacting us via email at kiemono@example.com. Account deletion is permanent and cannot be undone. Following deletion, your personal data will be handled in accordance with our Privacy Policy.

KIEMONO reserves the right to suspend or delete your Account and to terminate your access to the Platform at any time, without prior notice, if we believe that you have violated these Terms, posed a legal risk to the Platform, or upon lawful request by the competent authorities.

KIEMONO reserves the right to discontinue all or part of the Platform services at any time with or without cause, with reasonable notice of at least thirty (30) calendar days before the discontinuation takes effect.
